Hukuk ve Etik Bağlamında Kent Konseyleri: Mevzuatın ve Uygulamanın Genel Bir Değerlendirmesi

Abstract

Citizens' Assemblies have been on our agenda since 2005. First, the law was passed. Then these regulations entered the regulation. It's been 16 years since the decision. In the last ten years, in which we have been actively involved in this adventure, we have seen that many of the problems faced by those who run the Citizens' Assemblies and those who are in them remain in the context of ethical rules. However, we found that the qualification and its answers are sought in the legislation. So we decided that we should specify what is ethical and what is law. As it is known, ethics are rules that are not based on any law or written text. Citizens' Assemblies should also have such rules. It has even begun to happen. In other words, the Citizens' Assemblies should be considered as the ethical rules of the Citizens' Assemblies "the sum of the behaviors that are outside the relevant and regulated area in terms of legislation and whose compliance is in accordance with the structure and basic philosophy of the councils". In this paper, we will touch on the ethical aspects of the Citizens' Assembly through examples from practice. We will try to provide evaluations and suggestions by looking at the issues that are mandatory in terms of legislation.
